Boundary Change Tauriko/Pyes Pa West

At a meeting of the Joint Governance Committee of the Tauranga City and Western Bay of Plenty District Councils on the 6th of August 2008 it was resolved:

a.  That it be recommended to Western Bay of Plenty District Council that as the proposer it be confirmed that the proposal is not to be withdrawn subsequent to the receipt of submissions in accordance with s13 of Schedule 3 to the Local Government Act 2002, and

b.  That subject to (b) above, the reorganisation scheme, (including the amended scheme plan) identified as Attachment 1 to this report, be adopted as presented.

c.  That officers be instructed to give public notice of the decision and notify relevant parties in accordance with s18(2) of Schedule 3 to the Local Government Act 2002 upon confirmation of (b) above, with the date of the decision being the date confirmation is received.

d.  That, if there are no appeals in accordance with Schedule 3 Clauses 20 & 21 of the Local Government Act 2002, the reorganisation scheme be referred to the Minister for the preparation of an Order in Council to give effect to it.

e.  That subject to (d) the Minister be advised that the Joint TCC / WBOPDC Committee request that the reorganisation scheme be given effect to as soon as practical for administrative and procedural reasons associated with land development within the area in the scheme.

f.   That the two Chief Executives have delegated authority to put in place the necessary side agreements to deal with administrative and procedural matters.

The decision was subject to confirmation by the proposing Authority, Western Bay of Plenty District Council. That confirmation was given at a Council meeting on 27 August 2008 where it was resolved:

THAT, in accordance with S13 of Schedule 3 of the Local Government Act 2002 the Western Bay of Plenty District Council confirms that the proposed boundary adjustment as considered by the Tauranga City Council/Western Bay of Plenty District Council Joint Governance Committee on Wednesday 6 August 2008 not be withdrawn subsequent to the receipt of submissions.

The Appeal period closed 27 September 2008 and no appeals were received by the Joint Governance Committee or the Local Government Commission.   The Committee has therefore requested that the Reorganisation Scheme and Map be implemented by Order in Council with an effective date being 1 January 2009.
